Personalisation, Risk and Safeguarding Adults: The Legal Implications

This course considers personalisation, self directed support and personal budgets in adult social care (and the NHS). It looks at these in relation to risks to vulnerable people including health and safety, abuse and neglect – and what this means for the policy and practice of safeguarding adults.

It covers:

Personalisation:
self assessment, resource allocation systems (RAS), self directed support, personal budgets, direct payments;
how these elements of personalisation fit into community care (and NHS) legal rules about assessment, services, needs, care plans, resources etc.
“support brokerage” and the implications for professionals.

Risk:
legal rules about risk, including the balancing of risks and benefits;
mental capacity: additional considerations;
health and safety at work legislation;
common law of negligence;
the fear of litigation if things go wrong: what the law really says.
 
Safeguarding adults
considering the tension between the old style "paternalistic” welfare state" and new style "choice, control, independence";
safeguarding obligations: how is the new style of choice and responsibility consistent (practically and legally) with protection of vulnerable adults.
 
Overall the aims and objectives are for:
those attending to have an opportunity to think through the legal and practical implications of personalisation;
to discuss positively how to aim for the good points about personalisation whist avoiding the practical and legal pitfalls; 
to consider these issues in a practical way using case examples and case studies in order to understand the policy and the law.
